Court Refuses to Increase MBBS seats - Eklavya Overseas

Bengaluru's Kempegowda Institute of Medical Sciences’ plea for increasing the MBBS seats from 120 to 150 in the academic year of 2017-2018 has been rejected by the Supreme Court. However, the jury, headed Chief Justice Dipak Misra by have allowed the application to be considered for 2018-2019. The application had been filed by the approval of the representative lawyer, Mahalakshmi Pavani, and with a writ petition from the apex court, to allow the institute to have additional 30 seats to incorporate more students in the MBBS program. After careful consideration of the application from the institute, the jury, which also involved justices A M Khanwilkar and D Y Chandrachud “no final decision has been taken on the proposal for enhancement of intake capacity from 120 to 150 seats by the competent authority, the question of granting relief to permit the petitioner-institution to admit upto 150 students in MBBS course for the academic session 2017-18 cannot be countenanced.” The jury also pointed out that because the selection and admission date for the year 2017-2018 has already passed, the request for the increasing the seats can’t be approved because it won’t matter anyway, since the period to fill in applications and entrance exams has already expired.
The court did provide some relief and has already ordered the MCI to look into the case, inspect and regulate a thorough investigation of the institute and create a report regarding all the deficiencies that are plaguing it and then they’ll grant another opportunity to the institute to review their application and agree to give them the required amount of seats. This is a considered response to the institute, that weighs in the reality of the situation to the needs of the institute and how to fulfill them accordingly.
